Congress leader files petition in Supreme Court over political crisis in Maharashtra

NEW DELHI: Congress leader Jaya Thakur has filed a petition in the Supreme Court in the midst of the ongoing political deadlock in Maharashtra, demanding that the contesting of MLAs who have resigned or disqualified from the assembly should be banned for 5 years. In the application, citing the political crisis in Maharashtra, immediate intervention has been sought.

Jaya Thakur has said in this application that in 2021 she had filed a petition that how the government was being brought down by defying the anti-defection law. MLAs who resign from the assembly become ministers in the new government. Then, despite the issue of notice from the Supreme Court, the reply of the Central Government has not yet come.

Jaya Thakur's petition, filed in 2021, has demanded that Article 191(1)(e) of the Constitution and the Tenth Schedule be implemented. It has been said in the petition that the disqualified MLAs should be prevented from contesting by-elections till the term of the assembly for which they were elected.

It has been said in the petition that political events across the country have made the Tenth Schedule redundant. The legislators of the ruling party resign and later cooperate in forming the government of the other party. Those MLAs are also given ministerial posts in the new government and tickets to contest by-elections again.
