BJP MPs' Audacity: Accuse Supreme Court of Inciting Civil War In The Country
NEW DELHI: The Bharatiya Janata Party (BJP) has now directly targeted the Supreme Court with two BJP MPs stating that the Supreme Court is responsible for inciting religious and civil wars in the country. This has raised deep concerns not only among political, intellectual, and constitutional figures but also among legal experts, who have termed the situation as serious.
BJP MP from Godda, Jharkhand, Nishikant Dubey, has said that the Supreme Court is responsible for inciting religious and civil wars in the country. Similarly, BJP Rajya Sabha MP Dinesh Sharma made a comparable remark, asserting that no one can direct the Lok Sabha or Rajya Sabha as per the Indian Constitution.
These statements have sparked a political uproar, with all opposition parties strongly condemning the remarks of the BJP leaders.
The BJP MP from Godda, Jharkhand, claimed that the Supreme Court and Chief Justice Sanjiv Khanna are responsible for any civil war occurring in the country. He stated, “The Supreme Court is overstepping its boundaries. If everything has to go to the Supreme Court, then there is no need for Parliament or state assemblies; they should be shut down.”
Following this, BJP Rajya Sabha MP from Uttar Pradesh, Dinesh Sharma, also commented on the Supreme Court. Supporting Nishikant Dubey’s statement, he said, “When Baba Saheb Ambedkar drafted the Constitution, he clearly outlined the powers of the legislature and judiciary.”
He added, “According to the Indian Constitution, no one can direct the Lok Sabha or Rajya Sabha, and the President has already given assent to this. No one can challenge the President, as the President is supreme.”
The main opposition party, Congress, has condemned Nishikant Dubey’s statement with the senior Congress leader and spokesperson Jairam Ramesh accusing the BJP of attempting to weaken the Supreme Court.
He said, “Constitutional authorities, ministers, and BJP MPs are speaking against the Supreme Court because the court has stated that laws must not violate the basic structure of the Constitution. If a law is against the Constitution, we cannot accept it.”
Jairam Ramesh further stated, “The Congress party wants the Supreme Court to remain independent and impartial, and the rights granted to it by the Constitution must be fully respected. However, it is clear that deliberate voices are emerging to target the Supreme Court. From electoral bonds to the Waqf Board, the Supreme Court has declared the government’s actions unconstitutional.”
He said, “These people are now threatening the Supreme Court.” He added, “Do you know what Article 142 of the Constitution, created by Dr. Ambedkar, is? The BJP is fraudulently threatening a religious war in the country. Today, you are in power and have become so extreme that you are threatening the Supreme Court with a religious war.”
He urged the Prime Minister to stop such people who are weakening the country, saying, “The country will not forget this.”
Jharkhand Mukti Morcha spokesperson Manoj Pandey also condemned Nishikant Dubey’s statement, saying, “Dictatorship in the country has reached such a level that these people are now threatening the Supreme Court.”
He questioned, “Are these people more capable than the Supreme Court judges?”
Samajwadi Party leader ST Hasan, reacting to Nishikant Dubey’s statement, said that these people are engaging in Hindu-Muslim politics to win votes. He stated, “They are responsible for creating anarchy in the country. They oppose Azaan, hijabs, and demolish madrasas with bulldozers. These are the people creating civil war-like conditions in the country, not the Supreme Court. The Supreme Court is working to protect the Constitution and democracy of the country.”
CPI leader Binoy Viswam also criticized Nishikant Dubey’s statement, saying that the BJP and RSS are responsible for inciting communalism in the country.
Following the BJP MPs’ remarks on the Supreme Court, BJP President JP Nadda clarified that the party does not agree with the statements of the two MPs. Distancing the BJP from the remarks, he posted a lengthy tweet, stating, “The statements made by BJP MPs Nishikant Dubey and Dinesh Sharma regarding the judiciary and the Chief Justice of the country have no connection with the Bharatiya Janata Party. These are their personal statements, and the BJP neither agrees with such statements nor ever supports them.
He said,”The Bharatiya Janata Party has always respected the judiciary, wholeheartedly accepting its orders and suggestions, as we believe that the Supreme Court and all courts of the country are an integral part of our democracy and a strong pillar of constitutional protection. I have directed both MPs and everyone else to refrain from making such statements.”
Legal experts have also expressed concern over Nishikant Dubey’s statement. Senior Supreme Court advocate Vikas Singh called the statement highly irresponsible. He said, “The Constitution clearly defines the roles of all constitutional institutions. If Parliament passes a law, it requires the President’s approval to be implemented.” He questioned, “If the President does not approve a law passed by Parliament, would it be valid? Making such statements is highly irresponsible.”
