Supreme Court Stays Certain Provisions Of Waqf(Amendment Act,2025)

 NEW DELHI:The Supreme Court, on Waqf (Amendment) Act, 2025, stated that there is no basis for imposing a blanket stay on the entire Waqf (Amendment) Act, but it has stayed two significant provisions.

According to sources,the stated that the District Collector cannot determine whether a property is Waqf or not, as this interferes with the roles of the legislature and judiciary and violates the principle of separation of powers.

 

 It said,the provision requiring a person to be a follower of Islam for five years to create a Waqf has also been stayed.

These stays will remain in effect until the state governments establish rules to determine who qualifies as a follower of Islam and who does not,the Supreme Court said.
