Unnao Rape Case: Delhi HC rejects plea to suspend 10-year sentence in custodial death case of Kuldeep Sengar

 (Fast Mail):--The Delhi High Court on Monday  rejected the plea filed by expelled BJP leader Kuldeep Singh Sengar seeking suspension of his 10-year sentence in the case of the custodial death of the Unnao rape survivor's father.

Justice Ravinder Dudeja stated, "No grounds are made out for granting relief. The application seeking suspension of sentence is dismissed."

The judge noted that although Sengar has spent a long time in jail,approximately 7.5 years, relief cannot be granted on the basis of delay, as the delay was partly caused because he had filed multiple applications/appeals in his case.

While fixing the next date of hearing for March 3, the court observed, "If the appeal is heard expeditiously, the purpose will be served."

 A lower court had, on March 13, 2020, sentenced Sengar to 10 years' rigorous imprisonment along with a fine of ?10 lakh in the custodial death case of the rape survivor's father.

The court had then remarked that no leniency could be shown in the death of the "sole breadwinner" of a family.

In the same case, Sengar's brother Atul Singh Sengar and five others were also sentenced to 10 years in prison for their involvement in the custodial death.

The father of the rape survivor was arrested under the Arms Act on the directions/instigation of Sengar, and he died in custody on April 9, 2018, due to police brutality. Sengar had abducted and raped a minor girl in 2017.
