Supreme Court puts brake on putting nameplates on Kanwar route

 NEW DELHI: The Supreme Court has imposed an interim stay on shopkeepers  putting nameplates on Kanwar route till July 26.The Supreme Court has issued notice to the governments of Uttar Pradesh and Uttarakhand, Delhi and Madhya Pradesh and has asked them to respond by Friday. The order will remain in place until the states respond,the court said.

The apex court has said in its interim order that shopkeepers will not be required to reveal their identity. They will only have to tell the type of food; it is necessary to tell whether the food is vegetarian or non-vegetarian. The next hearing of the case will be on July 26.

 

 

 During the hearing before the bench of Justice Hrishikesh Roy and Justice SVN Bhatti, the lawyers of the petitioners said in their arguments that this is a worrying situation.The court noted that enforcing such orders without supporting provisions may infringe upon the secular character of the country.

“Police officers are creating division. Minorities are being identified and economically boycotted”,the petitioners said. Petitioner's lawyer CU Singh argued that the government's order is like dividing the society,in a way, it is like identifying minority shopkeepers and economically boycotting them.

The Supreme Court asked- Was this a press statement or an order? The petitioner's lawyer said that first a press statement came. Then there was public outrage. The state government says "voluntarily", but they are strictly implementing it. The petitioner's lawyer said that this has never been done before. There is no statutory support for this. No law gives the Police Commissioner the right to do so. The instructions are for every hand-cart, hawker, tea-stall. No purpose is served by revealing the names of employees and owners.
