Bengal SIR : Supreme Court refuses to grant voting rights to deleted voters

 NEW DELHI: The Supreme Court bench headed by CJI Surya Kant and Justice Joymalya Bagchi heard related petitions today. It has maintained its earlier stand: it will not allow interim inclusion or voting rights for deleted voters whose appeals are pending before the 19 appellate tribunals (headed by retired High Court judges).

Key points from recent proceedings:The electoral rolls were frozen on 9 April 2026. Voters deleted under SIR (especially the ~27 lakh found ineligible after adjudication of 60+ lakh doubtful cases) will not be able to vote in the upcoming West Bengal Assembly elections (phases starting 23 April 2026).

The Court emphasized that voting rights are a constitutional and emotional right, but the verification process needs finality. It said, “We do not want to rush it” and “We cannot get blinded by the dust and fury of impending elections.”

 

 Wrongly deleted genuine voters can still approach the appellate tribunals. If their appeal succeeds, their names can be added in a supplementary list later — they will be able to vote in future elections or by-elections, but not in this current assembly poll cycle.

Total deletions in Bengal under SIR reached around 88–91 lakh (about 11.6% of the original electorate), reducing the voter list from ~7.66 crore to ~6.77 crore.

If your name or someone you know was deleted and an appeal has been filed, the best option is to pursue it before the appellate tribunal. You can also check your status on the National Voters’ Service Portal (nvsp.in) or through the Voter Helpline (1950).
