Uttarakhand High Court Lifts Stay on Panchayat Elections

 (Fast Mail):-- The Uttarakhand High Court has lifted the stay on panchayat elections in the state.A division bench comprising Chief Justice G. Narender and Justice Alok Mahra, while hearing various petitions challenging the reservation ‘roster’ for the three-tier panchayat elections, directed the State Election Commission to issue a new election schedule.

The bench also instructed the state government to respond within three weeks to the issues raised by the petitioners. During the hearing, serious questions were raised regarding the reservation process for the seats of Block Pramukh and District Panchayat Presidents.

The petitioners argued that the election process for Block Pramukh and District Panchayat President is conducted in the same manner. According to the petitioners, 63 percent of the seats for Gram Pramukh in Dehradun’s Doiwala block have been reserved.

 

 The petitioners contended that the reservation ‘roster’ has allowed representation by the same category for several seats over a prolonged period, which violates Article 243 of the Constitution and repeated orders of the Supreme Court.

Advocate General S.N. Babulkar and Chief Standing Counsel C.D. Rawat, representing the government, informed the court that based on the report of the commission dedicated to backward classes, it is necessary to declare the previous reservation ‘roster’ null and void and consider the current panchayat elections as the first phase.

Earlier, on June 23, the High Court had imposed a stay on the panchayat elections in the state. As per the election schedule previously announced by the State Election Commission, the panchayat elections in 12 districts of the state were to be held in two phases on July 10 and 15, with vote counting scheduled for July 19.
