Supreme Court Grants Interim Bail to Professor Ali Khan Mahmudabad

NEW DELHI: In a significant development, the Supreme Court has granted interim bail to Professor Ali Khan Mahmudabad, an assistant professor at Ashoka University in Sonipat, Haryana. The case stems from his alleged objectionable comments on social media regarding "Operation Sindoor" and two female Indian Army officers, Colonel Sofia Qureshi and Wing Commander Vyomika Singh.

The bench, comprising Justice Suryakant and Justice N. Kotiswar Singh, approved the interim bail for Professor Mahmudabad. He was represented in court by senior advocate Kapil Sibal.

During the hearing, Sibal presented the professor's Facebook post that triggered the controversy. Justice Suryakant remarked that while every individual has the right to express their opinions, the timing of such communal remarks raised questions.

He noted,"The country was in a difficult situation at that time. Our citizens were under attack. Why make such a statement at that moment? Was this an attempt to gain popularity? Was this the right time for such remarks?"

 

 Representing the Haryana government, ASG S.V. Raju argued that Professor Mahmudabad should have sought relief from the High Court before approaching the Supreme Court directly. In response, Kapil Sibal highlighted the personal circumstances of the professor, stating that his wife is pregnant and that he had been sent to jail, emphasizing the urgency of the situation.

Along with granting interim bail, the Supreme Court has issued a notice to the Haryana government in this regard and ordered the formation of a Special Investigation Team (SIT) consisting of three IPS officers to investigate the case.

The court has imposed restrictions on Professor Mahmudabad, including, prohibition on posting any further controversial comments related to the case on social media.

He was also asked to surrender his passport to the Sonipat court.

This ruling provides significant relief to Professor Mahmudabad while ensuring that the matter undergoes a thorough investigation.
